1. OUR AGREEMENT WITH YOU
1. PUTTING OUR ARRANGEMENT IN PLACE
1.1 In this Agreement, we are 555 Online Limited of 155 New Road Side, Leeds, LS18 4DR and you are the person detailed on the Order Forms.
1.2 Our Agreement is made on the date we deduct payment from your credit card the details of which you provided on the Order Form.
1.3 Our Agreement includes all correspondence from us to you and the descriptions of the Goods as provided by us on our Website or otherwise.
2. MAKING YOUR CHOICE AND ORDERING
2.1 peruse our Website and select your chosen products.
2.2 Complete the Order Form in full and follow the instructions detailed on the Website.
3. WHAT HAPPENS NEXT
3.1 We may acknowledge receipt of your order on our website or by email. This is not our acceptance of your order, but confirmation that it has been received. Unfortunately we are not able to honour sales for products priced incorrectly online.
Please note that completion of the online checkout process does not constitute our acceptance of your order. Our acceptance of your order will take place only when we dispatch the product(s) or commencement of the services that you ordered from us.
3.2 If your chosen products are in stock your Order will be processed. We will deduct the price payable for your chosen products from your nominated credit card and your chosen products will be despatched to you within 48 hours.
We aim to process each order as quickly as possible. Each order is passed through a security check to help protect ourselves and our customers from fraudulent activity. If an order is marked as a potentially high risk transaction we may request further information from you regarding your address. Once this information is received the order will be processed efficiently. To help avoid this issue, please ensure that when you are entering your address details for your credit or debit card, your billing address for the card matches the one you have entered on our website.
If orders do not pass our payment checks then there is a chance they will be cancelled and/or refunded.
3.3 Should you not receive your chosen products within 10 days of us confirming their availability to you, please contact us to let us know so that we can investigate with the courier. (Non UK mainland orders allow up to 20 days). You will then be given the choice of:
3.3.1 cancelling your order whereupon we will refund the Price you paid or
3.3.2 wanting a further agreed time period after which if your chosen products have not been received then option 3.2.1 will be available to you.
3.4 Should you choose option3.3.1 then your refund will be made to the credit card you nominated on your Order Form or PAYPAL account used when placing the order.
3.5 Daniel Footwear may cancel the order if:
3.5.1 If the goods you have ordered are unavailable for any reason
3.5.2 One or more of the goods you ordered was listed with an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
3.6 We will deliver the goods ordered by you to the address you give us for delivery at the time you make the order.
3.6.1 Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.
4. IF YOU ARE NOT SATISFIED
4.1. You may return the products to us where upon a full refund will be made provided that the products are returned unworn and in the same conditions and packaging as received within 28 days of your receipt of the goods for a refund. Failure to notify us of a return or failure to comply with our returns process may result in a delay with your request being processed or accounted for. In the interests of hygiene we do not offer refunds on pierced jewellery, Please also note that items must be returned with all of the barcode tags intact.
4.2 We offer a free UK returns service for all products. You simply need to generate a royal mail returns label on this URL https://www.royalmail.com/track-my-return/create/3566 stick it completed on the package. Take your order to the local post office and request a tracking reference, so you are able to track your return. Ensure you keep all proof of postage for your return, we are not liable for items that go missing if there is no proof of postage/tracking number.
If you are not returning your parcel via our Royal Mail service or a different courier, please ensure you keep all proof of postage for your return. We are not liable for any items that go missing with other couriers.
It is also advised that you use a recorded service so the parcel can be tracked. We are not liable for any items that go missing with other couriers. Daniel Footwear does not refund any postage paid.
4.3 Items returned to us after 28 days will be refunded in the form of web credit.
4.4 Return of faulty or damaged goods should be made in accordance with the arrangements detailed in the information pack which accompanied your chosen products.
4.5 All returns must be sent back with a returns form including your order number, your name, product details and reason for return. All items must be returned in their original packaging, unworn and undamaged. Returns must be packaged in waterproof packaging with our returns address clearly marked on the parcel, Daniel Footwear does not refund packaging costs for the return. We request that customers do not tape, mark or write on product boxes or packaging. Failure to follow these instructions may result in your return being refused and returned to you. If you have not received a returns form with your order, please contact our customer services team.
4.6 For free promotional items: all promotions items, whether won or received together with an original purchase is not returnable on its own for a refund.
4.7 For items bought that includes a free promotional item: in the event of a return for refund, the customer is expected to return the promotional item together with the original item bought otherwise the retail price of the promotional item will be deducted from the refund amount.
4.8 Under the Sale of Goods Act 1979 we reserve the right to refuse a refund claim for reasons already stated in our terms and conditions.
4.9 We offer free UK returns on both full price and sale items
4.10 Failed Deliveries - our courier will attempt to deliver a minimum of 2 times, if your item is not delivered within the minimum attempts it will be returned to ourselves, the delivery charge will not be refunded, the price you paid for your items will be placed into web credit and you will be contacted by email or phone to see whether you want a refund or the item re sending out.
5. BASIS OF SALE
5.1 The terms of this, Our Agreement with You, shall govern our contract to the exclusion of any other terms and conditions.
5.2 Any typographical clerical or other error or omission in any sales literature price list acceptance of offer or other document or information issued by us is subject to amendment by us where reasonable in all of the circumstances to do so.
5.3 You are responsible for ensuring the accuracy of your Order and the details provided in your Order Form.
5.4 The quantity and description of your chosen products shall be those set out in the Order Form unless we subsequently agree otherwise.
6. PRICE OF THE GOODS
6.1 the price of the Goods shall be the price quoted by us on our Website next to the illustration/description of your chosen products, unless agreed otherwise by us in writing.
6.2 The price is inclusive of any payable value added tax in the UK. Customers outside of the UK are liable to pay any local customs and duty fees
6.3 Buy One Get One Free Add an item to your shopping basket from a buy one get one free promotional catalogue and you may add a further item from the same catalogue at no extra charge. The cheaper of the two items will be free. Items from different promotions cannot be mixed - for the purposes of calculating the free item; items must come from the same promotion. If you cancel the full price item in your basket prior to dispatch, the free item will revert to full price as currently displayed on the site. Returns of combination purchases ("buy one, get one free" or "get the lowest priced item free"), you must return any free items or vouchers back with the product for us to process a refund.
7. RISK AND PROPERTY
7.1 Risk of damage to or loss of your chosen products shall pass to you on delivery of them.
7.2 Not withstanding delivery and the passing of risk in your chosen products or any other provision of this Agreement property in your chosen products shall not pass to you until we receive cleared funds payment in full of the price of your chosen products.
7.3 If you select deliver to safe place and a parcel is subsequently lost, the liability will rest with yourself and we accept no blame for missing parcels in this instance.
8.1 we warrant that you will be entitled to the benefit of any warranties or guarantee given by you the suppliers to us of your chosen products. This does not affect your statutory rights.
8.2 You warrant that the information entered onto the Order Form is true.
8.3 Where we sell to you under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) your statutory rights are not affected by this Agreement.
9. FORCE MAJEURE
We shall not be liable to you or be deemed to be in breach of this Agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond our reasonable control:-
9.1 Act of God explosion flood tempest fire or accident;
9.2 war or threat of war sabotage insurrection civil disturbance or requisition;
9.3 acts restrictions regulations bye-laws prohibitions or measures of any kind on the part of any governmental parliamentary or local authority;
9.4 import or export regulations or embargoes;
9.5 strikes lock-outs or other industrial actions or trade disputes (whether involving employees of us or of a third party);
9.6 power failure or breakdown in machinery.
10.1 if any provision of this Agreement is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected thereby.
10.2 The Contract shall be governed by the laws of England
11. WHOLE AGREEMENT
the terms and conditions set out in this Agreement represents the entire Agreement.
12. CANCELLATION POLICY
If you are a consumer, you may cancel your contract with us for the goods you order at any time within 14 days from the date you placed the ordered goods. You do not need to give us any reason for canceling your contract nor will you have to pay any penalty. To cancel your contract you must notify us in writing by hand delivered notice, post or email.
If you have received the goods before you cancel your contract then you must return the goods in their original condition to us at the address above at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us in their original condition to the address above at your own cost and risk as soon as possible.
Once you have notified us that you are canceling your contract, any sum debited to us from your credit or debit card will be re-credited to your account as soon as possible and in any event within 30 days of cancellation provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
Daniel Footwear acts as an introducer and not a lender of unregulated credit products provided by Klarna Bank AB (publ). Klarna's Pay in 3 / Pay in 30 days are unregulated credit agreements. 14. DELIVERY TERMS
UK Mainland Standard: Delivery takes 2-4 working Days. (Sent via DPD or Royal Mail). Our standard delivery charge is £4.99
Next Day: Orders placed before 13.00pm Monday – Thursday will be sent next working day via Courier service DPD. Expect delivery between 9-5 Monday – Friday, no deliveries are made over the weekend. Our next day delivery charge is £6.99
Please note most deliveries will require a signature, so please ensure someone is available to receive the parcel at the delivery address. After a third failed delivery attempt your parcel may be returned by our courier and a redelivery charge may occur for it to be resent.
On some occasions we can arrange for your parcel to be left in a secure location however we are not liable for any damage/loss that may occur from this. Please contact us if you would like your parcel to be left in a safe place or contact the courier directly to arrange this.
International orders are shipped as quickly as possible using DPD, you will receive a confirmation email with a tracking number once your parcel has been despatched. To help you estimate when your order should arrive, please use the table below.
Please note any parcels being delivered outside of the UK will be subject to local taxes and customs which are to be paid by the recipient.
